TERMS OF SERVICE
✦ GENERAL
1. By purchasing either illustrations, sketches, or designs from me, you agree that you have read and understood the rules and will abide by them.
2. Failure to follow any rule can result in getting warned or blocked immediately.
3. Time zone is GMT-6.
4. You must be authorised to make online payments to place an order.
6. You must be 18+ and legally able to engage in an agreement or have a legal guardian to make the agreement on your behalf to purchase a commercial license.
7. None of my illustrations or designs shall be used for AI training or blockchain-related technologies such as NFT or cryptocurrency or any related future inventions under any circumstances.
8. I reserve the right to decline an order without explanation.
9. It is not obligatory for me to provide transparent backgrounds and non-watermarked illustrations/designs.
11. You are permitted to modify the design, however, please keep the original recognisable.
12. Credits to the original creator of the design is obligatory under all circumstances.
13. Do not claim the design and artwork as your own.
14. It is permitted to gift or trade the design.
15. The design can not be resold for more than its monetary value. Only the exact value of a commission increases its monetary value. If the design is obtained by gift, trade, or any activities that doesn't include funds, it can only be gifted or traded.
✦ PAYMENT
Payment can be made by PayPal or Ko-fi depending on the preferance of the client. All payments shall be made within a week of the proposal's delivery unless otherwise stated. The payment may be made in two manners and upon negotiation,1. Payment all at once: the whole amount shall be paid at once within the deadline of a week.
2. With a down payment (or deposit): In case of not being able to pay all at once, the design can be held pending with a down payment of 30% (or the value negotiated) of the total amount. The held period shall not be longer than 3 weeks.In case you decide not to proceed with the purchase after the down payment is made or miss the deadline, the down payment is non-refundable due to the risk of holding him and turning away other potential buyers during the reservation period.If you miss the payment deadline of a week without any explanation, your order will be cancelled and the design will be available for adoption. Please contact me in case you need more time with a proper explanation.
HOLD is not available without a down payment.
✦ COPYRIGHT
a. Ownership.
1. All adoptable's base usage limit is "personal purpose" only.
2. Ownership is transferred to you, but in all cases I remain the copyright.
3. All adoptables with a commercial license purchased includes an exclusive right.
5. You cannot distribute, transfer, or resell the commercial license/right to anyone else.b. Personal use vs Commercial use.
All my illustrations, sketches, and designs are only available for personal purposes with non-transferable rights. In case of using it for commercial or promotional purposes, you must discuss it with me beforehand. Either way, when publishing it, credit will be required (any of my social media links or usernames.) No commercial license grants you the right to use my work without giving credit.1. Personal use: using the character design or illustration as your social media icon/banner, your device wallpaper, printing it out only for yourself, role-playing, and sharing it on non-promotional accounts.
2. Commercial use: using the character design or illustration as branding assets, promotional assets (e.g., thumbnails, Vtuber art, video assets, etc.), Vtuber models, and merchandise production (prints, stickers, postcards, keychains, stands, etc.). Utilizing the character design or illustration in any way that you will profit from monetarily (promotion included).✧ Further information related to "commercial use"
1. Fees vary depending on the usage of the work and the scale of your business.
2. If your order includes a VTuber character either pre-debut or streaming, you must purchase a commercial license, and it will particularly fall under "Commercial: Streaming / content use," even if it's not specifically aimed to be used for commercial or promotional purposes.✧ "Commercial use" specification
1. Monetised content: for content creators and businesses who want to use the design as part of creating and distributing commercial and monetised digital content.a. Licensee: Individual or Legal Entity (Company)
b. Commercial use:
└ Allowed : creation and distribution of digital and products shared to commercial and monetised social and content platform accounts belonging to the Licensee.
└ Not allowed : 1. Creation and re-selling of value-add or derivative digital or physical end products made with the design by Licensee. / 2. Distribution of asset file(s) "as-is" unless otherwise stated.
c. Credit the artist
└ Required for all public uses unless otherwise stated.
└ Do not claim credit or copyright over the design.----------2. Commercial merchandising: For businesses who want to create, promote, and re-sell their own digital or physical end products made with the design.a. Licensee: Individual or Legal Entity (Company)
b. Commercial use:
└ Allowed : 1. Creation, distribution, and re-selling of value-add or derivative digital or physical end products made with the design by Licensee. / 2. Creation and distribution of digital and physical content to promote the re-selling of value-add digital or physical end products created by the Licensee.
└ Not allowed : Re-selling the design "as-is" without any value add activities.
c. Credit the artist
└ Required for all public uses unless otherwise stated.
└ Do not claim credit or copyright over the design.
✦ REFUNDS
1. Refunds are not acceptable under any circumstances.
